Holistic ? part 2 :: Nashville Personal Trainer - Life Fitness Academy

Continuing in this series about how we define holistic as it pertains to our business, it?s time to talk nutrition. We are holistic in our approach to fitness because we recognize the vital role that food and nutrition have in health and wellness. Nutrition is lost in most gyms across America. In fact it?s lost in most doctors offices, grocery stores, and schools also?but those places are for another blog entirely. It?s funny to me how things are relatable anymore in the fitness industry when it comes to nutrition. For example: use the food pyramid and then make it a numbers game with charts and graphs trying to stay at or below a certain number servings or calories every day?which only makes nutrition more complicated. That?s where we come in!

Here at Life Fitness Academy we really strive to be comprehensive in our nutrition research and education?but not to bore you with the facts so much as to make it simple and easy to understand. As our business continues in research and self-testing we turn that around and hand that to our clients in these 3 important ways:
1) Learn about your food. Always ask why!
2) Use food as a tool to achieve whatever it is you need from your body.
3) Enjoy food and don?t be bound to it.

Our aim is to educate and motivate you to learn about your food. Over time, we teach you how to weigh the good information with the bad. This is done by constant research on our part with a few simple questions guiding us. Can I make this (ingredient or food) at home? Can I do better with this (sugar, wheat, dairy, meat, etc..)? Will I feel better or worse with this food? Has this food been tested over time (thousands of years). Is this food ideal? These questions come after identifying what?s going on in the body and how we can effectively help it with nutrition.

Once we have answered those questions as well as figured out your goals (ie. healing, weight loss, weight gain or achieving whole health), we can then start sourcing the various foods, herbs and/or remedies to assist in that process. It is a journey that takes time and we try to educate you along the way, answering the why questions with you, not for you.

Once you have gained this new lease on life and have a better understanding of how food works with your body or what it is you are consuming, you may enjoy it! With your new found food knowledge, enjoying food should keep you from some of the same food choices that could?ve caused the problem in the past.

Our research turns into education for you, which empowers you to reach your goals, gives you perspective, and gives you the passion to share and educate your family. It?s how fitness is supposed to work. Often it happens the opposite?where a trainer or nutritionist sits back and drops crackers on the floor so you can be dependent on them over and over again. Now go (or come)! Go! Learn! Come! Learn! Do it! Succeed! Then teach others!

Scientist claims to have sequenced ?Bigfoot? DNA

A frame from the October 20th, 1967 Patterson-Gimlin film claiming to depict BigfootA Texas scientist claims to have sequenced the DNA of Sasquatch, a creature whose very existence is mysterious to many and purely mythological to most.

"Our study has sequenced 20 whole mitochondrial genomes and utilized next generation sequencing to obtain 3 whole nuclear genomes from purported Sasquatch samples," Dr. Melba S. Ketchum of Nacogdoches, Texas, says in a news release.

"The genome sequencing shows that Sasquatch mtDNA is identical to modern Homo sapiens, but Sasquatch nuDNA is a novel, unknown hominin related to Homo sapiens and other primate species."

Ketchum writes that her team's research indicates the "North American Sasquatch" is a hybrid of a female Homo sapien and a male of "unknown hominin species," whose DNA matched approximately 15,000 years ago.

Sasquatch, more commonly known as Bigfoot, has been a staple of American mythology for hundreds of years. The modern Sasquatch theories took on a newfound prominence in 1958 when the first official Bigfoot search party was launched in California.

Most members of the scientific community have discounted the Sasquatch theory. However, in a Sept. 27, 2002, interview with National Public Radio, Jane Goodall appeared open to the concept, saying, "Maybe they don't exist, but I want them to."

So, how do Ketchum's claims hold up under scrutiny?

The Houston Chronicle's Eric Berger does some unraveling of Ketchum and the claims she made in the news release.

For starters, Berger notes that while Ketchum has 27 years of genetic research experience during her career as a veterinarian, her company, DNA Diagnostics, has received an "F" rating from the Better Business Bureau.

But more important, Ketchum has not allowed scientific peer review of her findings.

"That is a massive red flag. Real research scientists almost never preannounce their research findings," Berger writes. "In effect she is using the mantle of science to confer credibility on her discovery, without actually deserving the credibility."

And finally, where exactly did Ketchum get her DNA sample? After all, if she was working from a reliable source, that alone might be the real story because no physical evidence of Bigfoot exists on record.

As it turns out, Ketchum says her DNA sample was obtained from a blueberry bagel left in the backyard of a Michigan woman who claims that 10 Sasquatch creatures visit her property on a regular basis.

In other words, it seems likely that the legend of Bigfoot will remain more myth than reality for the foreseeable future.

White House blasts GOP ?obsession? with Rice and Benghazi

Arizona Sen. John McCain, the ranking Republican on the Senate Armed Services Committee?flanked by fellow committee??The White House sharply escalated its attacks Tuesday on Republicans trying to stop Ambassador to the United Nations Susan Rice from succeeding Hillary Rodham Clinton as secretary of state. Press secretary Jay Carney described GOP lawmakers as being gripped by a politically fueled "obsession" with a series of television appearances Rice made shortly after the deadly Sept. 11 attack on the U.S. diplomatic compound in Benghazi, Libya, in which she wrongly suggested the attack had stemmed from a demonstration over an anti-Muslim video rather than a terrorist assault.

Carney's comments came after Rice met privately on Capitol Hill with Republican senators who have said they intend to block her nomination if President Barack Obama chooses her to replace Clinton as the nation's top diplomat.?Rice also acknowledged for the first time, in a written statement issued by her office, that her initial public comments on the Benghazi assault were wrong because there had been no protest outside the compound.

Carney said the U.S. still does not know who carried out the assault, which claimed the lives of Ambassador Chris Stevens and three other Americans. But he said GOP focus on Rice's early statements was a politically motivated distraction from efforts to identify those responsible for the killings.

"The questions that remain to be answered have to do with what happened in Benghazi, who was responsible for the deaths of four Americans, including our ambassador, and what steps we need to take to ensure that something like that doesn't happen again." Carney said.

In appearance after appearance, Rice said that American intelligence had pinned the blame on the assault on extremists who took advantage of a demonstration outside the facility.

Tuesday, Rice acknowledged the information initially provided by the intelligence community was wrong.

"Neither I nor anyone else in the administration intended to mislead the American people at any stage in this process, and the administration updated Congress and the American people as our assessments evolved," Rice said.

Rice, accompanied by Acting CIA Director Michael Morell, met with Republican Sens. John McCain of Arizona, Lindsey Graham of South Carolina and Kelly Ayotte of New Hampshire, who have accused Rice (and the Obama administration in general) of misleading the public by tying the assault to the video. Republicans have suggested the administration hoped to blunt the potential political impact of the attack?the first to claim the life of an American ambassador in 30 years?shortly before the presidential election.

"Bottom line: I'm more disturbed now than I was before," Graham told reporters after the meeting. "We are significantly troubled by many of the answers that we got and some that we didn't get," McCain said.

Carney shot back, saying there were "no unanswered questions" about Rice's early televised statements.

"The focus on?some might say obsession on?comments made on Sunday shows seems to me and to many to be misplaced," Carney said. "I know that Sunday shows have vaunted status in Washington, but they have almost nothing to do?in fact zero to do?with what happened in Benghazi."

And neither, to hear Carney tell it, did Rice.

"Ambassador Rice has no responsibility for collecting, analyzing and providing intelligence, nor does she have responsibility as the United States ambassador to the United Nations for diplomatic security around the globe," he said.

So why, then, did the White House anoint Rice the administration point person to answer questions about a possible intelligence failure and consular security? Why not Secretary of State Clinton? Director of National Intelligence James Clapper? Defense Secretary Leon Panetta? National Security Adviser Tom Donilon?

"She is a principal on the president's foreign policy team," Carney said.

He added, "To this day it is the assessment of this administration and of our intelligence community ? that they acted at least in part in response to what they saw happening in Cairo and took advantage of that situation."

In other words, according to one well-placed source, the perpetrators of the attack may have concluded that anger at the video gave them the maximum opportunity to get sympathy or support across the Muslim world, and might even inspire copycat attacks.?Rice's much-dissected Sept. 16 comments broadly follow those lines.

Obama has fiercely defended Rice, while carefully declining to say whether he has chosen her to succeed Clinton. Another leading contender is the Democratic chairman of the Senate Foreign Relations Committee, John Kerry.

McCain and Graham have pledged to try to filibuster her confirmation, but they are well short of the votes needed to do so.

Officer: General didn't direct Manning's treatment

FORT MEADE, Md. (AP) ? A retired Marine Corps colonel denied Tuesday that a three-star general directed the harsh pretrial confinement of an Army private charged with passing reams of classified documents to the secret-spilling website WikiLeaks.

Daniel Choike was installation commander of the Quantico, Va., Marine Corps base during Pfc. Bradley Manning's nine months of confinement there from July 2010 to April 2011. He testified at a pretrial hearing for Manning.

Manning is seeking dismissal of the case, alleging he was illegally punished by conditions that included being locked up alone at least 23 hours a day, being forced to sleep naked for several nights and being forced to stand naked at attention one morning.

His lawyers contend the conditions were directed by Lt. Gen. George Flynn, who was commander of the Marine Corps Combat Development Command at Quantico at the time. Confronted by civilian defense attorney David Coombs with a series of emails that included Flynn and Choike, Choike testified he kept Flynn informed about the situation but that Flynn never influenced the decision to keep Manning on maximum security and prevention-of-injury status.

"Gen Flynn was not in the decision-making chain," Choike said. "Gen. Flynn never once influenced anybody."

Instead, Manning's custody status was determined by the brig commander, he said. That position was held during Manning's confinement by Chief Warrant Officer 4 James Averhart and then by Chief Warrant Officer 2 Denise Barnes.

Choike defended the brig commanders' decision to keep Manning classified as maximum-custody detainee who posed a threat of injury to himself or others. The classification was contrary to the recommendation of mental-health workers who examined him.

Court recessed for the evening after more than five hours of testimony from Choike.

Choike acknowledged that Flynn had expressed interest in Manning's confinement due to the nature of the charges and international media attention to the case. Choike said Manning was under suicide watch when the soldier arrived at Quantico from Kuwait, and Flynn wanted assurance that everything was being done to keep him safe. Another prisoner had committed suicide in the brig the previous December.

Choike said Manning's custody status was determined in part by his odd behavior, including licking the bars of his cell, "erratic dancing" and lifting invisible weights. Coombs suggested that the bar-licking occurred during sleepwalking and that the other behaviors were merely exercise.

Choike said Manning's jailers took away his underwear at night starting March 2, 2011, after he made what they regarded as a suicidal comment: "I have everything I need right here to be able to harm myself. The waistband of my underwear can do this." Coombs suggested the comment stemmed from Manning's frustration at being kept on injury-prevention status.

A day later, Manning was forced to stand naked at attention for morning inspection by a guard who told him he wasn't allowed to cover himself with his blanket, Coombs said. Choike denied any knowledge of such an order. If the guard gave it, "That would be wrong," Choike said.

"And why would that be wrong?" Coombs asked.

"It serves no purpose," Choike said.

Before the hearing Tuesday, about two-dozen Manning backers held up signs of support outside the post. Then they attended the proceeding, many wearing black T-shirts with the word "Truth" in white lettering.

The U.S. government claims the disclosures attributed to Manning endangered lives and security. Manning supporters say the leaks exposed war crimes and triggered pro-democracy uprisings in the Middle East.

Judges can dismiss all charges if pretrial punishment is particularly egregious, but that rarely happens. The usual remedy is credit at sentencing for time served, said Lisa M. Windsor, a retired Army colonel and former Army judge advocate now in private practice in Washington.

In a 1956 case, U.S. v. Bayhand, a military appeals court ordered all charges dismissed against a soldier who had been forced during his pretrial confinement to do hard labor alongside a sentenced prisoner. The court ruled that the soldier had been given an illegal order.

Since then, there have been few, if any, cases in which pretrial punishment has led to dismissal of all charges. Lt. Col. Eric Carpenter, chairman of the criminal law department at the judge advocates school in Charlottesville, Va., said he couldn't find one but he couldn't say for sure that the remedy hasn't been granted.

Manning has also offered to take responsibility for the leak by pleading guilty to reduced charges. The military judge hasn't yet ruled on the offer and prosecutors have not said whether they would still pursue the charges against him.

The military contends Manning's treatment at Quantico was proper, given his classification as a maximum-security detainee who posed a risk of injury to himself or others. He was later moved to Fort Leavenworth, Kan., where he was re-evaluated and given a medium-security classification.

A United Nations investigator called the conditions of Manning's time at Quantico cruel, inhuman and degrading, but stopped short of calling it torture.

The 24-year-old native of Crescent, Okla., faces possible life imprisonment if convicted of aiding the enemy, the most serious of the 22 charges.

He is accused of sending hundreds of thousands of classified Iraq and Afghanistan war logs and more than 250,000 diplomatic cables to the secret-spilling website WikiLeaks while he was working as an intelligence analyst in Baghdad in 2009 and 2010.

The materials Manning is suspected of leaking include sensitive reports on foreign governments and leaders, Iraq and Afghanistan war logs and a 2007 video clip of a U.S. helicopter crew gunning down 11 men later found to have included a Reuters news photographer and his driver. It was the video that garnered the most worldwide attention from the leak. As for the video clip, the Pentagon concluded the troops acted appropriately, having mistaken the camera equipment for weapons.

A garden writer heads to Phoenix, where they really turn up the heat

An Iowa gardener hikes the Phoenix Mountains to enjoy the saguaro cactus plants -- and the winter heat.

Sitting outside at the hotel in Phoenix is relaxing and warm, but that mountain in the background beckons.

Last winter, Zone 5 Iowa, where I? live, became Zone 7 Iowa. Which is to say, for the first time in history the temperature did not go below zero. Kinda nice. Almost toasty.

Then we had a prolonged heat wave this summer. Not so nice. Drought.

But despite the fact that US. weather researchers say that our temps in the past year were the highest since record-keeping began in 1895, the need still exists here to escape the cold. (OK, so I?m a weather wimp.) And one of the few direct flights from this little burg goes to Phoenix

So inside of three hours or so I was relaxing by the pool at the Arizona Biltmore,? an ersatz Frank Lloyd Wright project designed to look midway between a Mayan temple and a mausoleum. At long last, I am warm again.

Phoenix Mountains

There's another bonus of staying at this architectural icon: quick access to the Phoenix Mountains desert preserve. Only 20 minutes from the pool.

OK, so I wanted to get warm, but this rocky incline was hot. Most sensible hikers were carrying water, but I figured I?d only get sweatier lugging the stuff up the mountainside. Six of one ?

Now this place isn?t exactly gardenesque, but it is dang impressive. I don?t know how even cactus grows here. But all around were those wondrous saguaros, all looking as though they were being held up.

Did you know it takes about 75 years for that cactus to grow its first arm? This is another reason national parks in the West have trouble with a different kind of rustler ? cactus rustlers. Seems some McMansion owners don?t have the patience to wait for their own cacti to reach for the sky.

An hour of stumbling over mountain rubble in the baking sun, and I?d enjoyed about as much as I could stand. So I went back to the pool. Funny. I went to the pool the first day to get warm. But now I?m going there to cool off.

The cerebral cortex of the human brain has been called "the crowning achievement of evolution." Ironically, it is so complex that even our greatest minds and most sophisticated science are only now beginning to understand how it organizes itself in early development, and how its many cell types function together as circuits.

A major step toward this great goal in neuroscience has been taken by a team led by Professor Z. Josh Huang, Ph.D., at Cold Spring Harbor Laboratory (CSHL). Today they publish research for the first time revealing the birth timing and embryonic origin of a critical class of inhibitory brain cells called chandelier cells, and tracing the specific paths they take during early development into the cerebral cortex of the mouse brain.

These temporal and spatial sequences are regarded by Huang as genetically programmed aspects of brain development, accounting for aspects of the brain that are likely identical in every member of a given species including humans. Exceptions to these stereotypical patterns include irregularities caused by gene mutations or protein malfunctions, both of which are now being identified in people with developmental disorders and neuropsychiatric illnesses.

Chandelier cells were first noticed only 40 years ago, and in the intervening years frustratingly little has been learned about them, beyond the fact that they "hang" individually among great crowds of excitatory cells in the cortex called pyramidal neurons, and that their relatively short branches make contact with these excitatory cells. Indeed, a single chandelier cell connects, or "synapses," with as many as 500 pyramidal neurons. Noting this, the great biologist Francis Crick decades ago speculated that chandelier cells exerted some kind of "veto" power over the messages being exchanged by the much more numerous excitatory cells in their vicinity.

Born in a previously undiscovered 'country'

After three years of painstaking work that has involved using new technologies to identify and trace neural cell progenitors in ways not previously possible, and to track them as they migrate to positions in the maturing cortex, Huang and colleagues, including Dr. Hiroki Taniguchi now at the Max Planck Florida Institute, have demonstrated that chandelier cells are born in a previously unrecognized portion of the embryonic brain, which they have named the VGZ (ventral germinal zone).

Huang, who has been on a decade-long quest to develop means of learning much more about the cortex's inhibitory cells (sometimes called "interneurons"), points out that while they are far less numerous than the excitatory pyramidal cells all around them, cells including chandelier cells that inhibit or modulate excitatory-cell messages play an indispensable role in balancing message flow and ultimately in determining the functional organization of excitatory neurons into meaningful groups.

This is all the more intriguing in the case of chandelier cells, Huang explains, because of their distinctive anatomy: one cell that can regulate the messages of 500 others in its vicinity is one that we need to know about if we want to understand how brain circuits work. Unlike other inhibitory cells, chandelier cells are known to connect with excitatory cells at one particular anatomical location, of great significance: a place called the axon initial segment (AIS) ? the spot where a "broadcasting" pyramidal cell generates its transmittable message. To be able to interdict 500 "broadcasters" at this point renders a single chandelier cell a very important player in message propagation and coordination within its locality.

Because of the strategic importance of such cells throughout the cortex, it has been a source of frustration to neuroscientists that they (and other inhibitory cells) have been difficult to classify. Huang has pursued a strategy of following them from their places of birth in the emerging cortex.

Many inhibitory cells come from a large incubator area called the MGE (medial ganglionic eminence); until now, it was not known that most chandelier cells are not born there, and indeed do not emerge until after the MGE has disappeared. Only at this point does the much smaller VGZ form, providing a place where neural precursor cells specifically give rise to chandelier cells.

The team learned that manufacture of a protein encoded by a gene called Nkx2.1 is among the signals marking the birth of a chandelier cell. The gene's action, they found, is also necessary to make the cells. Nkx2.1is a transcription factor, whose expression has previously been linked to the birth of other inhibitory neuronal types. Huang's team observes that it is the timing of Nkx2.1's expression in certain precursors -- following disappearance of the MGE and appearance of the VGZ -- that enabled them to track the birth, specifically, of chandelier cells.

Highly specific migration route and cortical destinations

"In addition to being surprised to discover that chandelier cells are born 'late'?after other inhibitory cells ? in a part of the cortex we didn't know about," says Huang, "our second surprise is that once born, these cells take a very stereotyped route into the cortex and assume very specific positions, in three cortical layers." (Layers 2, 5 and 6). "This leads us to postulate that other specific cortical cell types also have specific migration routes in development."

As Huang points out, his team's new discoveries about chandelier cells have implications for disease research, since it is known that the number and connective density of chandelier cells is diminished in schizophrenia. Associations of the same type have recently been made in epilepsy.

"To know the identity of a cell type in the cortex is in effect to know the intrinsic program that distinguishes it from other cell types. In the broadest terms, we are learning about those aspects of the brain development that make us human. 'Nurture,' or experience, also has a very important role in brain development. Our work helps clarify the 'nature' part of the nature/nurture mystery that has always fascinated us," Huang says.

Gold medalist Oksana Baiul sues talent agency

LOS ANGELES (AP) ? Olympic gold medalist Oksana Baiul (by-YOOL') is suing a talent agency claiming it mismanaged money she earned after her gold medal-winning figure skating performance in 1994.

The lawsuit filed in Los Angeles claims she signed contracts with the William Morris Agency shortly after her victory but only recently discovered that hundreds of thousands of dollars had gone uncollected or were improperly spent.

The lawsuit claims the Ukrainian-born skater signed the agreements without being able to read, write or understand English. She claims the agency failed to properly explain agreements to her and misrepresented the amounts she is owed.

The agency, now known as William Morris Endeavor, declined comment.

Baiul now lives in Pennsylvania and is seeking more than $1 million, although the exact amount owed would be determined by jurors.

China detains man for Twitter joke on party meet

BEIJING (AP) ? Hundreds of Chinese Internet users are rallying around a Beijing blogger who has been detained by police after posting a joke on Twitter about the pivotal Communist Party congress.

Chinese authorities have been especially sensitive to any perceived dissent about the party meeting, which closed last week after ushering in a new generation of leaders. Ahead of the event, police sent activists out of Beijing and rounded up the hundreds of people who tried to draw the attention of central authorities to their grievances against local governments.

Zhai Xiaobing's Nov. 5 tweet suggested the next movie in the "Final Destination" horror franchise would be about the Great Hall of the People collapsing on party delegates.

The tweet said, "An earthshaking debut will be seen at the global premiere on Nov. 8!" The weeklong congress began Nov. 8.

After Zhai's Twitter account fell silent for a few days, Liu Yanping, a friend of his, grew worried and visited his home in Miyun county in Beijing's northeastern suburbs. There, his family members told Liu that Miyun county police had taken Zhai away on Nov. 7 and seized his computer, Liu said.

A Miyun county police officer who would only give his surname, Sun, told The Associated Press on Wednesday that Zhai was being investigated for "spreading terrorist information." The charge carries a maximum penalty of five years' imprisonment.

Zhai's supporters call the allegation absurd and more than 400 people have signed an online petition calling on police to release him ? and to have more of a sense of humor.

"I was very shocked when I realized what happened to him. I've consulted a few lawyers and I feel that it's clear his Twitter joke does not amount to spreading terrorist information," Liu said. "It's just preposterous."

Liu said she and a few other activists have been in touch with Zhai's family and would help hire a lawyer. She said state security officials visited Zhai's wife to warn her to keep a low profile.

Zhai's wife, when reached by phone, declined to comment on her husband's situation.

The online petition, written by outspoken blogger and free speech advocate Wen Yunchao, urges authorities to lighten up.

"We solemnly request that Beijing police find a little sense of humor and not make a big deal out of nothing," the letter said. "In particular, do not destroy the goodwill and anticipation the public has for the new office holders after the 18th party congress by limiting and persecuting an ordinary citizen's normal freedom of speech in such a groundless fashion."

Further enquiries were directed to the Beijing Public Security Bureau, which did not immediately respond to a faxed list of questions.

A rights group said Zhai's case could be seen as a test of whether China's incoming leaders will continue a steady crackdown authorities have imposed on the country's small community of activists, dissidents and lawyers in recent years.

"The new leadership has two choices: continue down the path of criminal prosecution to signal that they are unwilling to change, or release Zhai to show goodwill that it is responding to popular demands for greater freedom," said Maya Wang, a Hong Kong-based Asia researcher for Human Rights Watch.

High Intensity Interval Training: A Big HIIT - Intramural Sports ...

If you are like me, spending an hour on the treadmill or elliptical can feel like a waste of time. Not only is it a huge time investment, but I rarely get the fat burning results I am looking for. I have a very stubborn body fat (and metabolism) and finding a cardio workout that is both effective and efficient has been a huge challenge. However, recently I discovered high intensity interval training (HIIT) which, according to experts? claims, burns more fat over a longer period of time.

For those of you who don?t know what HIIT is, it consists of a warm up, followed by six to twelve repetitions of high intensity exercise, alternating with a lower intensity period in between, and ending with a cool down. The idea is for the high intensity portion to be done full throttle while the lower intensity is done at about 50%. A normal HIIT session lasts about fifteen to twenty minutes. The target ratio you need to shoot for is a 2:1 ratio of work: rest. I personally started with 1(work):3(rest) and then moved to 1(work):2(rest) and will continue to progress with a 1(work):1(rest) then the 2(work):1(rest). Short and sweet, right?!? But does itreally burn the fat?

An East Tennessee State University (2001) study showed that following an 8-week HIIT program dropped 2 percent in body fat while those who followed a continuous steady-state treadmill program had no drop in body fat. Another study by Florida State University (2007), showed that subjects who performed HIIT burned almost 10 percent more calories during the 24 hours following exercise in comparison to continuous steady-state exercise, despite the fact that the total calories burned during the workouts were the same. So, the science would seem to support the fat burning claims. But how does it work for obstinate body fat like mine? I find that I do burn more fat (according to the percent body fat on my scale anyway) doing HIIT three times a week than I have in the past doing long treadmill/elliptical workouts. Now, I know what works for me won?t necessarily work for everyone else but I do think it is an efficient alternative to longer steady-state workouts. What about you, have you tried HIIT? What were your results?

At the end of the 1970s, '80s and '90s, homeowners in many areas cashed in big profits when they sold. This enabled them to trade up to a bigger home, sometimes in a better neighborhood.

Homeowners used their homes as piggy banks through the use of home equity lines of credit (HELOCs) to buy cars, pay for vacations and medical bills, renovate their homes, and pay for college educations and retirement.

The recent housing recession brought a halt to this as home values dropped 30 percent or more, depending on location, wiping out equity for some and leaving many who bought with a low cash down payment with negative equity. More than 24 percent of homeowners in the U.S. today have a mortgage value that exceeds the market value of their homes.

2012 may be a pivotal point in the housing market. The decline in home prices has subsided and prices are actually moving higher in some markets. Buyers, instead of being reticent to buy a home that may lose value, are now anxious to buy before prices rise further. Lawrence Yun, chief economist for the National Association of Realtors, projects that home prices nationally will rise 5 to 10 percent over the next three years.

Does this mean that we're moving back to a housing market that will enable homebuyers to treat their homes as an investment opportunity rather than just as a place to live?

There are still possible bumps ahead for the housing market. Millions of foreclosure properties have yet to come to market. The global economy is slowing, and U.S. economic and job growth are meager. Even so, some buyers who purchase in choice locations today could realize substantial gain when they sell.

HOUSE HUNTING TIP: High-demand neighborhoods are usually located close to centers where job creation is high. A good transportation system enhances home values, particularly if your neighborhood is near a hub that provides the means to travel in several directions. Some areas have benefited from foreign homebuyers.

Location has been touted as the key factor determining home value. That is still the case. Buyers want quality housing in close proximity to green spaces, recreation, good shopping and transportation.

One strategy is to buy a home that lacks curb appeal and could use updating that's located in a neighborhood of superior homes. The neighborhood is already known as a winner. Your challenge is to bring the property up to the quality of the neighboring homes by making cost-effective improvements.

Shoddy renovations will be seen for what they are when you sell. Hire quality contractors at a reasonable price. Some homeowners do not make back what they paid for improvements when they sell. To ensure you don't overimprove for the neighborhood, find out what buyers want and how much they're willing to pay for it before you renovate.

For example, in California, a study conducted by UCLA and the University of California, Berkeley, showed that homes with a "green label" sold for approximately 9 percent more than comparable nonlabeled homes. A green-label home is labeled by Energy Star, Leadership in Energy and Environmental Design (LEED), and GreenPoint Rated.

There's a certain amount of luck involved in making a profit on a home sale. For instance, buying a home in the next hot spot and waiting for the neighborhood to turn around before you sell could yield a tidy profit. A neighborhood that's adjacent to one that's already highly desirable might be a good place to look.

Patience will work for you if your aim is to come out financially whole or ahead of the game when you sell. Plan to hold for the long term. Don't sell in a down market.

THE CLOSING: If the market presents an opportunity to sell sooner, take it, unless your home means more to you than profit.

    Don?t Care How, Samsung Wants Copy of Apple-HTC Settlement Now

    For a company that says it has no intention of settling its patent battle with Apple, Samsung sure is curious about the details of the iPhone maker?s recent settlement with Android handset-maker HTC. On Friday Samsung asked a court to force Apple to provide it with a copy of the HTC deal, arguing that it likely covers some of the patents involved in its own case with Apple.

    ?As you know, the issue of Apple?s willingness to license its patents was briefed in Samsung?s opposition to Apple?s motion for permanent injunction,? Samsung wrote in its filing with the court. ?This license has direct bearing on the question of irreparable harm and whether monetary remedies are adequate.?

    Now, Samsung already knows that at least two of the patents Apple asserted against it were also asserted against HTC. But what it really wants to know is whether they were Apple?s most prized patents, the ones it said in court that it was unwilling to license ? especially to rivals. ?These patents are Apple?s unique user experience intellectual property,? Boris Teksler, Apple?s director of patent licensing and strategy, said during testimony in the Apple-Samsung trial. ?They?re the ones that make our brand identity and keep competitive us in the marketplace.?

    If Apple did license those patents to HTC, then it may well have given Samsung a new weapon with which to fend off the company?s request for a permanent U.S. sales ban on some of its products. Apple?s request for that injunction is based on the company?s argument that Samsung?s behavior caused it ?irreparable harm.? If Apple?s deal with HTC shows that it was willing to accept licensing fees for the same IP it said it couldn?t possibly license to Samsung, the argument for an injunction loses its teeth. Monetary damages should suffice.

    Said Samsung, ?The HTC license bears directly on Apple?s assertion in its reply brief that ?Apple considers these patents ?unique to its user experience? and unavailable for licensing, particularly to competitors.??
